TERMS AND CONDITIONS FOR ALL CHILDCARERS
Please read this document carefully as it sets out the term and conditions between the Lemonjelly Childcare Solutions and all Candidates.
Theses Terms of Business are deemed to have been read, understood and accepted by the Candidate upon completion and return of our registration form. Any Candidate found to be supplying the Agency with false or misleading information will have their registration terminated.
DEFINITIONS:| “Agency” | Lemonjelly Childcare Solutions. |
| “Client” | means the person, firm, or company, to whom the Candidate is introduced. |
| “Candidate” | means the Childcarer who is introduced by the Agency to the Client. |
| “Engagement” | means the engagement, employment or use of the Candidate by the Client or any third party, following an introduction by Lemonjelly Childcare Solutions. |
| “Employer” | when the Client employs the Candidate they will become the Employer. |
| “Employee” | when the Candidate is employed by the Client they become the Employee. |
Lemonjelly Childcare Solutions acts as an introductory agency only.
Candidates must provide the Agency with a comprehensive employment, education and qualification history.
Candidates must provide the Agency with a minimum of 3 referees.
All candidates are required to hold an Enhanced CRB disclosure and proof of First Aid Training when registering with the Agency. In the event of these not being available the Agency will assist you in obtaining them
Candidates must agree to the Agency contacting previous employers and referees. Contact with present employers will not be made without the prior consent of the candidate.
All information communicated, whether written or verbally, shall be kept confidential between all parties. Do not divulge to any third party the detail of any family you have had an interview with. If you believe the position to be of interest to a friend or family member please contact the Agency.
Candidates give their consent for the Agency to contact them via telephone or email to inform them when new positions become available.
Candidates give the Agency permission to forward on their CV, references and other documentation to its Clients. Lemonjelly will always endeavour to contact candidates before doing this.
Candidates must not accept details of the same position from another agency.
The Agency will arrange all interviews for you and provide you with all the information you require. If you need to cancel an interview or placement at the last minute you must inform us, if verbal contact cannot be made with the Agency you must contact the family directly
Candidates must inform the Agency immediately of any offer of an Engagement made by a Client of the Agency.
Candidates agree to inform the Agency immediately to any change in their circumstances relating to an Engagement made by the Agency.
Lemonjelly Childcare Solutions offers excellent before and after placement advice and guidance. If you have any questions or queries please do not hesitate to contact us.
All Candidates’ must inform the Agency if families / nurseries contact them directly, all bookings and placements must be made through the Agency.
Candidates must not give out personal contact details to any families they babysit for, all future bookings must be made through the Agency.
It is the responsibility of the candidate to notify the Agency of any changes to their personal details, employment status, and should they wish to be removed from the Agency database.
In the event of a Client cancelling a babysitting booking without giving the requested 24 hours notice Lemonjelly will endeavour to recover for the babysitter a minimum of 3 hours salary, no guarantee of this is given.
In the event of a Client withdrawing from an engagement prior to the commencement of employment Lemonjelly will endeavour to recover for the candidate a minimum of one weeks salary, no guarantee of this is given.
The Friend Referral Scheme was introduced in October 2010, it is subject to the successful placement being permanent and the childcarer remaining in their position for a minimum of 12 weeks. Referrals must be made prior to registration. Gift vouchers will be issued once the qualifying conditions are meet.
The Agency shall not be liable under any circumstances for any loss, expense, damage, delay, costs or compensation (whether direct, indirect or consequential) which may be suffered or incurred by the candidate arising from or in any way connected with the Agency supplying the Client.
The Agency accepts no liability for any act or omission of any Client introduced by the Agency even if such act or omission is negligent or fraudulent or reveals any dishonesty
These Terms are governed by the law of England & Wales and are subject to the exclusive jurisdiction of the Courts of England & Wales.
These Terms and Conditions are valid from 23rd October 2010 and supersede all previous terms of business
